Your Privacy Choices

This page gives you direct ways to control how Action Potential Supplements ("APS") collects, uses, and shares your personal information. Depending on where you live, applicable laws may give you specific rights — including the right to opt out of the sale or sharing of your personal information, the right to opt out of targeted advertising, and rights to access, delete, correct, or receive a copy of your data. We honor these rights for any U.S. customer regardless of state, and we extend equivalent rights to customers in the EU, UK, and Canada.
Opt out of the sale or sharing of your personal information
We do not sell your personal information for money. However, we use third-party advertising partners (including Meta/Facebook and Pinterest) for cross-context behavioral advertising. Under California, Florida, Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and Delaware law, this counts as "sharing" or "selling" of personal information.
To opt out of this sharing, you can do any of the following:
- Submit a request. Email Privacy@myactionpotential.com with the subject "Opt Out of Sale/Sharing." Include the email address and any phone number associated with your APS account so we can apply the opt-out across our records.
- Enable the Global Privacy Control (GPC) signal in your browser. When we detect a GPC signal from your device, we automatically treat your visit as an opt-out request for that browser. Learn how at globalprivacycontrol.org.
- Decline marketing cookies in our cookie banner when you visit from a region where the banner is shown.
We will process your opt-out request within 15 business days and apply it to all of our records associated with your contact details.
Submit a Data Subject Access Request
You may request to access, correct, delete, or receive a portable copy of your personal information at any time. To submit a request, email Privacy@myactionpotential.com with:
- Your full name
- The email address associated with your APS account or order
- The type of request (Access / Delete / Correct / Portability)
- Any additional detail that helps us locate your records
We will verify your identity (typically by confirming order details), respond within 45 days as required by law, and may extend by an additional 45 days for complex requests with notice to you. If we deny your request, we will explain why and your right to appeal.
You may designate an authorized agent to make a request on your behalf. We will require written proof of authorization and may verify the request directly with you.
Limit the use of sensitive personal information
We do not collect sensitive personal information as defined under California's CPRA (such as race, ethnicity, biometric data, precise geolocation, or health/medical conditions). If you believe we have, please contact us at the email above and we will investigate and remove it.
Children
The Services are not intended for children under 16. We do not knowingly sell or share personal information of customers under 16.
How we honor signals and verify requests
- We honor the Global Privacy Control (Sec-GPC: 1) browser signal as an opt-out of sale/sharing.
- We do not currently honor "Do Not Track" signals, as there is no consensus standard for them.
- For deletion and access requests, we verify your identity by matching the email address you provide to our customer records, and may request order numbers or other corroborating detail to prevent fraudulent requests.
Florida residents — Data Sale Opt-Out
Under the Florida Digital Bill of Rights (Fla. Stat. § 501.71 et seq.), Florida residents have the right to opt out of the sale of personal information and the processing of personal information for targeted advertising. To exercise this right, follow the opt-out instructions above.
Right to appeal
If we deny your request, you may appeal by replying to the denial email or by sending a new email to Privacy@myactionpotential.com with the subject "Privacy Request Appeal." We will respond within 60 days. If your appeal is denied, you may contact your state Attorney General.
